The initial focus of the Immigration Law Center was on biomedical research scientists in one of the countries leading academic medical centers. We understand the inner workings of this unique environment and have been quite successful in working with individuals from all disciplines. Our central South Eastern location permits easy access to many of the country's premier universities.

Most research scientists seeking immigrant visa status will fall under the employment category in either EB1 or EB2 designation. "Outstanding Professor or Researcher" is a EB1 category for individuals who possess extraordinary ability in the arts and sciences. This category does not require one to go through the Labor Certification process, but does require a higher level of demonstrable achieved success. The EB2 category Professional with an advanced degree is available to individuals who possess exceptional ability. These individuals must go through the labor certification process as part of the process of obtaining an immigrant visa, unless it can be shown that it is in the "National Interest" to waive the cumbersome and time consuming labor certification process.

This area of immigration law (National Interest) is rapidly evolving and sometimes subject to a somewhat arbitrary determination by individual INS inspectors as to whether one individual possesses exceptional ability and whether there will be substantial benefit to the United States. Listed below are recent representative cases of successful National Interest Waiver cases processed by ILC.

Case 1 Assistant Professor
South Korean, 45, Ph.D. Physiology from US University, 14 invited lectures, 23 journal articles, 4 book chapters, 6 abstracts. Research focus: Ion Channels.

Case 2 Postdoctoral Fellow (PT)
Chinese M.D. (3 « yr.), 40, well published in China, ABD in United States Ph.D. program. Research focus: Cancer research, developed line of Transgenic Mice used in C-myc Oncogene to regulate gene expression.

Case 3 Postdoctoral Fellow
Chinese M.S., 35, US Ph.D. in Physiology, 20 journal articles, 1 patent. Research focus: Free Radical effect on Epithelial Ion Transport.

Case 4 Visiting Scientist
Russian, 37, MD, Ph.D., D.Sc., 75 journal articles, 22 invited lectures, 1 patent. Research focus: Immunologist with substantial exposure to Radiation damage to Thymus Stroma cells and T-cell Immunodeficiency formation.

Case 5 Assistant Professor
Nigerian/United Kingdom, 38, MD Hungary, Pathologist with limited publications but well educated and trained. Research focus: Solid Tumor cells.

Case 6 Tenure Track Assistant Professor
Argentinian, 35, MD, extensive clinical training, widely recognized as exceptional. journal articles, invited lectures (US. and international).

Case 7 Postdoctoral Fellow
Indian, 33, Medicinal Chemist, years post graduate training, international, 20 research publications.

Bulgarian, 36, Ph.D. in Physics, limited publications, working on 3-D Modeling for government contracts.
